Welcome to Power Play Fit (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of powerplayfitcbus.com and any services, programs, or digital content we offer (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy.

1) Who We Are

Power Play Fit provides fitness and nutrition coaching services delivered in person (Columbus, Ohio area) and/or virtually, including consultations, coaching programs, workout plans, and related resources.

2) Eligibility

You must be at least 18 years old to purchase or participate in paid Services. If you are under 18, a parent/guardian must purchase and consent in writing.

3) Health & Safety Disclaimer

Fitness coaching involves physical activity and inherent risks. We are not medical providers and the Services are not a substitute for medical advice, diagnosis, or treatment. Consult your physician before starting any fitness or nutrition program, especially if you have health concerns. You voluntarily assume all risks related to your participation. Stop any activity that causes pain, dizziness, or shortness of breath and seek medical attention as needed.

4) Booking, Scheduling & Attendance

Consultations & Sessions: Sessions may be delivered in person or online as specified at booking.
Rescheduling: You may reschedule with at least 24 hours’ notice. Late rescheduling or no-shows may be forfeited.
Lateness: Sessions end at the scheduled time; late arrival shortens your session.
Expiration: Session packages must be used within 6 months of purchase unless otherwise stated.

5) Payments, Pricing & Taxes

We use Stripe to securely process payments. By submitting a payment form, you authorize us (and Stripe) to charge your selected payment method for the amounts shown at checkout, including any applicable taxes. Prices and offerings are subject to change at any time prior to purchase confirmation.

6) Refunds & Cancellations

Consultations: Consultation fees are refundable only if cancelled at least 24 hours in advance.
Coaching Packages/Programs: Unless a specific guarantee is stated in the program description, all sales are final once the program begins. Prorated credits or transfers may be offered at our discretion for documented medical reasons.
Digital Content: Digital/program materials are non-refundable once delivered or accessed.
Chargebacks: If you initiate a chargeback without first contacting us to resolve a billing issue, we may suspend access to Services and pursue recovery of amounts owed.

7) Recurring Billing (If Applicable)

For memberships or subscriptions, you will be billed on a recurring basis as described at checkout. You can cancel future billing by contacting us at least 30 business days before your next renewal date. Cancellation stops future charges; it does not retroactively refund past charges.

8) Conduct & Community Standards

We aim to provide a supportive environment. Harassment, abusive language, hate speech, or unsafe conduct may result in removal from programs without refund. You agree not to upload, post, or transmit anything unlawful, harmful, or infringing.

9) Intellectual Property

All program materials, videos, PDFs, plans, and site content are owned by Power Play Fit or our licensors and are protected by intellectual property laws. We grant you a non-exclusive, non-transferable license for personal, non-commercial use only. You may not share, sell, distribute, or publicly post program materials without our written permission.

10) Recording Policy

To protect client privacy and our intellectual property, recording (audio/video/screen capture) of sessions or program content is not permitted without prior written consent.

11) Testimonials & Results

Testimonials represent individual experiences and do not guarantee results. Your outcomes depend on many factors, including your health status, effort, and adherence to guidance.

12) Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and share information (including via Gravity Forms, Stripe, and Mailchimp).

13) Third-Party Services

We may link to or integrate third-party tools (e.g., Stripe, video platforms, scheduling, or email marketing). We are not responsible for third-party sites or practices. Your use of third-party tools is governed by their terms and policies.

14) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

15) Limitation of Liability

To the fullest extent permitted by law, Power Play Fit and its representatives will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid for the Service giving rise to the claim in the three (3) months preceding the event.

16) Indemnification

You agree to indemnify and hold harmless Power Play Fit and our representatives from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, breach of these Terms, or violation of any law or third-party rights.

17) Changes to Services or Terms

We may modify the Services or these Terms at any time. If we make material changes, we will update the “Last updated” date and, when practical, provide notice. Continued use after changes means you accept the updated Terms.

18) Termination

We may suspend or terminate access to the Services for any violation of these Terms or for conduct that we reasonably believe is harmful, unsafe, or unlawful.

19) Governing Law; Venue

These Terms are governed by the laws of the State of Ohio, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Franklin County, Ohio for any dispute arising from these Terms or the Services.
